Supreme Court rules that fire and rehire is not lawful
I have signed an Early Day Motion recognising the importance of protecting workers' rights and banning the fire and rehire practice.
The motion welcomes September’s Supreme Court judgment in the case of Tesco Stores Ltd v Union of Shop, Distributive and Allied Workers and others. The outcome protects workers’ rights to retained pay and essential rules that fire and rehire cannot be used to undermine pay and conditions.
The motion goes on to congratulate USDAW for supporting their members through what has been a protracted legal process and is encouraged that the highest court in this land agrees that fire and rehire is not a lawful practise. It further welcomes the government's Plan To Make Work Pay.
The Plan To Make Work Pay will ban this awful practice of fire and rehire so workers can be safe in the knowledge that terms and conditions cannot be used to undermine pay and conditions.
It will also focus on boosting wages, making work more secure, supporting working people by delivering a living wage, and banning exploitative zero-hour contracts.
This is a significant step forward for workers in Blackpool and across the UK.
